Terms of Service
These Terms govern your use of Lynx. By creating an account, booking a provider, or offering services through Lynx, you agree to be bound by them. Please read carefully — Section 14 contains a binding arbitration clause and class-action waiver.
1. About Lynx
Lynx LLC operates a marketplace that helps parents find background-checked babysitters and youth trainers. Lynx is not a childcare provider, employer, agency, or referral service for employees. Providers on Lynx are independent contractors who use the platform to be discovered by, contract with, and be paid by parents directly.
2. Eligibility
- You must be at least 18 years old to use Lynx.
- You must be legally able to enter into binding contracts in your jurisdiction.
- Providers must additionally complete identity verification and pass our background-check process before accepting bookings.
3. Your account
You are responsible for keeping your login credentials secret and for everything that happens under your account. Notify us immediately at legal@thelynxnetct.com if you suspect unauthorized access. You must keep your contact and payment information accurate.
4. Bookings between parents and providers
When a parent books a provider, a direct contract is formed between the parent and the providerfor the requested service. Lynx is not a party to that contract. Lynx’s role is limited to facilitating discovery, communication, and payment.
- Provider standards: providers represent that the information on their profile is truthful and current and that they are legally permitted to offer the services they list.
- Parent responsibilities: parents are responsible for evaluating a provider, supervising the engagement as appropriate, and providing accurate booking information.
5. Background checks
Lynx conducts an identity and criminal background check on providers through a third-party vendor before they are eligible to accept bookings. A passed background check is not a guarantee of safety, fitness, or future conduct. Parents remain solely responsible for the decision to engage a provider and for the care of their children. Lynx makes no representation about the accuracy or completeness of background-check results.
6. Payments and fees
- Payments are processed by Stripe. By using the Service, you also agree to Stripe’s Connected Account Agreement.
- Lynx charges a service fee disclosed at checkout. We may change fees with notice; changes do not apply to bookings already confirmed.
- Funds for completed bookings are paid out to providers via Stripe Connect on a schedule disclosed in the Provider Hub.
- Taxes are the responsibility of the party who incurs them. Providers are responsible for income, self-employment, and any other applicable taxes.
7. Cancellations and refunds
- Parents may cancel a booking up to 24 hours before the scheduled start time for a full refund.
- Cancellations within 24 hours forfeit 50% of the booking amount; cancellations within 2 hours forfeit 100%, which is paid to the provider.
- If a provider cancels, the parent receives a full refund and we review the provider for repeat behavior.
- For disputes involving service quality or non-performance, contact support@thelynxnetct.com within 7 days of the scheduled session.
8. Acceptable use
You agree not to:
- Use Lynx for any purpose other than booking or offering child-related services in good faith.
- Misrepresent your identity, qualifications, or relationship to a child.
- Contact other users to circumvent the Lynx platform (e.g. to avoid fees).
- Harass, threaten, defame, or discriminate against other users.
- Upload illegal content or content that infringes another person’s rights.
- Probe, scan, scrape, or interfere with the technical operation of the Service.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
9. User content
You retain ownership of content you upload (profile photos, reviews, messages). You grant Lynx a worldwide, non-exclusive, royalty-free license to host, store, and display that content as needed to operate the Service. You can revoke this license by deleting the content, subject to reasonable retention for backups.
10. Reviews and reports
Reviews must reflect genuine first-hand experience and may not contain personal attacks, private information, or false statements. We may remove reviews that violate these rules. To report a safety issue, use the in-app report flow or email support@thelynxnetct.com.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” LYNX MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
LYNX IS NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF PROVIDERS OR PARENTS. PARENTS USE LYNX AT THEIR OWN RISK AND ARE SOLELY RESPONSIBLE FOR THE SAFETY AND WELL-BEING OF THEIR CHILDREN.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNX’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO LYNX IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS. LYNX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
13. Indemnification
You agree to defend, indemnify, and hold harmless Lynx and its officers, directors, employees, and agents from any claim arising out of your use of the Service, your booking activity, your content, or your violation of these Terms.
14. Arbitration and class-action waiver
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Hartford, Connecticut. You and Lynx waive the right to a jury trial and the right to participate in a class action or class arbitration. You may opt out of this Section 14 by emailing legal@thelynxnetct.com within 30 days of first agreeing to these Terms; opt-outs do not affect any other Section.
15. Governing law
These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws principles. To the extent any dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Connecticut.
16. Termination
You may close your account at any time in Settings. We may suspend or terminate your access for violation of these Terms, suspected fraud, or any conduct that risks harm to other users. Sections relating to payments owed, user content, disclaimers, liability, indemnification, arbitration, and governing law survive termination.
17. Changes
We may update these Terms from time to time. We will post the updated effective date and notify users in the app or by email at least 14 days before material changes take effect. Continued use of the Service after the effective date means you accept the updated Terms.
